DE LA GASCA & CIA., is the premier Intellectual Property and Litigation boutique firm in El Salvador.
We provide expertise in the prosecution and enforcement of Trademarks, Patents and Copyrights. In addition we are experts in handling complex litigation matters, particularly when related to intellectual property, commercial, civil, administrative and pharmaceutical law.
Our members have had longstanding experience in Intellectual Property and Litigation since at least 1998, through which we have assisted our clients to successfully solve their legal problems.
Our firm was founded by Managing Partner, Mr. Giancarlo de la Gasca after obtaining his LL.M. in Intellectual Property Law (with honors) at The John Marshall Law School in Chicago, IL; and having work experience in a well-known IP boutique firm of Chicago.
Thereafter, we created the Firm, with the purpose of offering specialized services by an expert team, which is fully bilingual and has an international perspective of the law, but most of all, an expert team that looks up to fulfilling the legal necessities of our clients until achieving their maximum satisfaction.

Giancarlo de la Gasca, Managing Partner
Giancarlo de la Gasca is a specialist in Intellectual Property and Litigation with over 16 years of related experience.
He is Licensed by the Supreme Court of El Salvador as a Lawyer as well as a Notary Public.
He obtained his JD from University Dr. Jose Matías Delgado (El Salvador - 2003), as well as an LL.M. in Intellectual Property with honors, from UIC-John Marshall Law School (Chicago, IL - 2008).
Furthermore, he is an Arbitrator listed within the Roster of Neutrals of the Salvadoran Chamber of Commerce (CAMARASAL) as well as the Interamerican Association of Intellectual Property (ASIPI).
Giancarlo’s experience includes having worked at law firms in El Salvador and the United States, as well as being head of the Registration and Intellectual Property Department at a major Regional Financial Institution.
He has focused is practice in the prosecution and enforcement of trademarks, patents and copyrights in El Salvador. As a litigator, he has successfully represented numerous clients in commercial disputes and settlements, related to intellectual property and other business issues.
Giancarlo has tried numerous cases with the Administrative Law Courts of El Salvador, both suing and defending government entities. Moreover, he has successfully represented clients at the Supreme Court of El Salvador obtaining favorable rulings.
Mr. de la Gasca has been ranked by Chambers & Partners as a Leading Intellectual Property Attorney (2008, 2015 – 2018), and has been recognized by Who’s Who Legal and Latin Lawyer’s independent research as one of the 37 leading Intellectual Property attorneys for Central America, while still under the age of 40.
Giancarlo has served as adjunct professor of Intellectual Property, Contract Law and Commercial Litigation at the University Jose Matias Delgado. Currently he is adjunct professor of Business Law at the MBA program of Universidad Tecnológica de El Salvador.
His pro-bono works includes serving as permanent legal advisor to Hogar Padre Vito Guarato, a non-profit entity that takes care of and shelters children with disabilities, abandoned by their parents. There he was made Honorary Member in recognition to the legal work given to the institution.

Nelly specializes in Intellectual Property, with special focus and experience in Patent and Trademark Prosecution.
She is Licensed by the Supreme Court of El Salvador as a Lawyer.
She obtained her JD from University Dr. Jose Matías Delgado (El Salvador - 2017), as well as an LL.M. in Business Law, from Pontificia Universidad Católica de Chile (Chile - 2019).
Nelly has had extensive experience in the prosecution of both Trademark and Patent portolios in El Salvador and abroad.
Through her years of practice, she has acquired in-depth knowledge and know-how in the clearance of Trademarks, providing valuable recommendations to clients who are interested in protecting their trademarks in El Salvador.
Furthermore, she has navigated the extremely complex world of patent prosecution, succesfully obtaining under her watch several patent registrations.
Nelly has been distinguished by Chambers & Partners as an Associate to Watch.
She joined the firm in 2013, and through these years, has grown professionaly to become a key member of the Firm.
She had previous working experience at the Supreme Court of El Salvador, as well as the Registry of Companies.
